If someone has sexually assaulted you while you were intoxicated, you may have concerns about being able to prove that you didn’t give your consent. What is important to understand, and what Marlo Greer points out in her TikTok on this topic, is that being drunk doesn’t give somebody the right to have sex with you. And you don’t have to be “roofied” for the sex to be rape.

Colorado law makes this clear. Someone can be guilty of sexual assault or unlawful sexual contact if they know that the person they are having sex with is “incapable of appraising the nature” of their conduct. Being drunk can obviously result in someone being in that state, and you don’t have to be “falling-down drunk” to be unable to give consent.

That also goes for civil lawsuits filed by sexual assault survivors against their attackers. If your attacker knew, or even had reason to know, that you were too drunk to properly consent to what they did to you, it may be possible to hold them responsible for their actions.
