The question might be casually dropped during a phone conversation with someone from an insurance company about your claim: “If it’s okay with you, I’m going to record this conversation” or “Just to make sure I don’t miss anything, I’m going to record this conversation.” It might seem reasonable to you at the time; after all, it’s hard to take detailed notes and isn’t it important that the insurance company has all of the information it needs to process your claim?

 

Beware

 

In that seemingly innocent request to record, there are traps for the unwary. You should never allow yourself to be recorded by an insurance company unless you have your lawyer present.

 

Why? Because many times, the insurance company representative will ask you questions that are scripted and designed by the company to get you to say things that the company can later use to reduce or refuse your claim. The questions won’t be obvious ones either; you won’t be asked, “So you’re not really injured all that badly, are you?” But you might be asked about pre-existing medical conditions, details of your accident that could be used to suggest you were to blame for your injuries, what activities you’ve engaged in since the crash, or other things that could provide the insurance company with ammunition to support their decision to reduce your recovery – or refuse your claim entirely.
