We all know that there are many good reasons for cops to give people tickets for drinking and driving. Cops will regularly explain how alcohol interferes with coordination, reaction time, and the ability to make sound decisions. Most people agree that taking steps to remove intoxicated people from the road makes things safer for both the intoxicated driver and everyone else. People who are not able to make sound decisions should not be on the road.
Much of this reasoning applies to the question of consent in sexual assault cases. As Marlo Greer explains in her TikTok on this topic, if you have been drinking a certain amount, you’re not in possession of all of your faculties. You can’t make good decisions. You cannot react quickly if you’re drunk. And the fact that you may be intoxicated does not give anybody the right to sexually assault you.
Too often, one of the questions police will ask when someone reports that they’ve been sexually assaulted is, “Have you been drinking?” – as if consuming alcohol could somehow be an excuse or an invitation for someone to commit sexual assault against you.
Colorado law agrees with this. A defendant can be found guilty of unlawful sexual contact or sexual assault if they are aware that the person they are making sexual contact with is “incapable of appraising the nature” of their conduct. And you don’t have to be so drunk that you can’t function in order to reach that point. Alcohol impairs your ability to make good decisions and to “appraise the nature” of your conduct.
