If you’re involved in a car crash, there’s no doubt it can be a very scary experience. Even a small “fender-bender” can cause the adrenaline to surge through your system and prompt you to say and do things you may regret later.

Here’s one problem with that – you may be held to account for what you say or do later on, especially if you’re suing or being sued for damages or personal injuries. This can happen in several ways:

  • Witnesses may tell investigators what you said and did
  • Video cameras are everywhere, and we all know how much fun it can be to watch a viral video of someone totally losing their cool
  • The other person involved in the crash may remember what you said and did and share it with their lawyer

The end result? You may have to sit through a very painful deposition where you are forced to repeat what you said or review video footage of you losing your cool and then have to agree and acknowledge that you did say those awful words and do those crazy things. You may even have to do so in open court if your case goes to trial.

Don’t Lose Your Cool

It’s easy to remember not to lose your cool when you’re reading these words on your laptop or phone. It’s much harder to do so when you’ve just been in an accident and are dealing with all the emotions that follow from that. But it can be very helpful to take the time now and again to remind yourself periodically that losing your cool rarely helps. So when that fateful day arrives, and the crunch of bent steel and breaking glass has died down, you will be able to deal with the situation in a reasonable way that won’t come back to bite you in the you-know-where if you end up involved in a lawsuit over the crash.

So instead of losing it, do the following:

  • Make sure you, your passengers, and anyone else involved in the crash are okay and not in harm’s way
  • Get the contact information for the other driver, including their insurance information
  • Call the police to get a police report
  • Take photos and videos of the crash scene
  • Get the names and contact information of any witnesses

These are much more constructive ways to respond to a crash than if you lose your cool and say and do a bunch of things that you’ll later regret.
