Many people are nervous about filing a claim when they’ve been injured in a rideshare crash. After all, in most cases, the driver is just some regular person trying to make a living like everybody else. Despite using an app, you know that your driver is most likely driving their own personal vehicle to get you to your destination. But in addition to that, your driver may work very hard to convince you not to do anything even if you’ve been hurt.

They may tell you, “Well, it was just an accident; accidents happen.” Or (incorrectly) argue that “rideshare companies are just apps.” As though there is nothing to be gained by making a claim with Uber or Lyft or whichever company was responsible for your ride. 

Other times, the driver will try to talk you out of making a claim. “We can figure this out between the two of us; there’s no need to call the police.” Or use the bizarre argument that “I’m not hurt” as if that means you shouldn’t be injured either.

Rideshare Injury Claims

Rideshare injury claims can be a bit complicated. While rideshare companies provide insurance for their drivers, it’s only active once the driver has turned on their rideshare app. 

That means that there are periods when the driver is in their car where the rideshare company’s insurance may not cover them. In those cases, the driver’s own insurance will be the primary coverage. In addition, the amount of that coverage may vary depending on what the driver is doing at the time of the crash. (Typically, the insurance coverage is less until the driver “accepts” a ride.) 

Once the driver accepts a rideshare request, the rideshare company’s insurance coverage will increase substantially. That higher level of coverage will stay in place until the passenger has been dropped off. 

There are two potential sources of compensation if you are injured in a rideshare crash: the rideshare company’s insurance and the driver’s insurance. 

But don’t forget, most crashes involve another vehicle. The other driver may share some or all of the responsibility for your injuries and is legally required to have their own insurance coverage. That increases the potential sources of coverage – and the complexity of the claim – to three. (Or more, if it’s a multi-vehicle accident.)
